What can I do when an airline unilaterally refunds a canceled EU-covered flight instead of offering replacement travel?

A unilateral refund is not the same as your informed choice to abandon travel. The Commission’s guidance addresses an airline that refunds without offering the required alternatives: a further claim for the price difference of comparable replacement transportation may arise. Preserve evidence that you wanted rerouting and were not given the choice.

Traveler organizing trip records and next steps after a flight disruption

What this answer depends on

  • Flights and passengers within Regulation (EC) No 261/2004. Check departure, destination, operating carrier and the specific conditions below; the airline name alone does not establish coverage.
  • The carrier must give comprehensive information about the Article 8 alternatives, and a properly informed passenger generally makes the choice once.
  • Where the carrier unilaterally refunds instead of offering the required choice, the guidance recognizes reimbursement of the price difference for a new ticket under comparable transport conditions.
  • A passenger who was properly offered assistance but nevertheless made independent arrangements may face a different result on additional costs.

Important exceptions

  • This is not a general right to reverse a freely chosen refund because a new ticket later became expensive. Comparable transport conditions and the carrier’s actual offer history matter. Package-travel refunds can have an additional organizer branch, and national dispute procedures may be needed if consent is contested.

What to do next

  1. Save the message showing the refund and the sequence of earlier communications. Identify whether you ever selected a refund button, accepted credit or otherwise chose to stop traveling.

  2. Notify the airline promptly that you wanted rerouting and ask it to provide the required choice. Avoid assuming the refund can simply be ignored while a seat remains reserved.

  3. If comparable replacement travel becomes necessary, keep the options considered, the original refund amount and the replacement receipt. Explain the price difference rather than claiming both fares in full without accounting for money returned.

  4. Submit the chronology and ask for review under the unilateral-refund branch. Include any airline evidence of consent and address it directly instead of omitting an unfavorable interaction.

  5. Have the cancellation, refund notice, account credit, offer screens, communications expressing a wish to travel, the replacement itinerary and its itemized price.
