How is EU delay compensation assessed when extraordinary and ordinary causes both affected the flight?

A single label may not explain a delay with several contributing events. The Commission’s guidance describes subtracting the delay attributable to extraordinary circumstances when assessing whether the remaining arrival delay reaches the compensation threshold. The carrier still needs to establish the relevant extraordinary event and reasonable measures; an unexplained mixed-cause label is not a complete calculation.

What this answer depends on

  • Flights and passengers within Regulation (EC) No 261/2004. Check departure, destination, operating carrier and the specific conditions below; the airline name alone does not establish coverage.
  • For a delay caused partly by extraordinary circumstances, the guidelines describe deducting the delay attributable to those circumstances from the total arrival delay when evaluating the compensation threshold.
  • The extraordinary-circumstances defense requires the carrier to establish the qualifying event and that its consequences could not have been avoided even with all reasonable measures.
  • The relevant arrival-time concept is when an aircraft door opens so passengers can leave, rather than touchdown alone.

Important exceptions

  • This is not an instruction to split every delay into arbitrary percentages. Overlapping causes, knock-on effects and available mitigation can require individual assessment. A qualifying defense to fixed compensation does not by itself remove separately applicable care, refund or rerouting obligations.

What to do next

  1. Build a timeline from the scheduled final arrival to the actual arrival. Keep all cause messages, especially where the explanation changed during the wait.

  2. Ask the airline to identify each event and the amount of delay it attributes to it. Request the causal link rather than treating the entire delay as weather-related because weather occurred at some point.

  3. Ask what reasonable measures were taken to limit the extraordinary event’s impact. Keep the airline’s response separate from your own observations or assumptions about other flights.

  4. In a challenge, identify the disputed time allocation or missing mitigation explanation. Do not invent an alternative minute-by-minute calculation when the evidence does not establish one.

  5. Have scheduled and actual final arrival, cause messages with timestamps, any airline breakdown of delay periods, prior-rotation references and mitigation information.

Does any weather involvement automatically remove all compensation?

No. The specific extraordinary event, attributable delay and reasonable-measures evidence matter.

Can I allocate half the delay to the airline without evidence?
