Can an airline reject my Canadian compensation request just because another passenger-rights regime may also apply?

Potential eligibility under another passenger-rights regime is not, by itself, a reason to refuse APPR compensation. Actual compensation already received for the same event is different: the Canada Transportation Act restricts a second payment under its regulations in that situation. Disclose both the claim history and any payment before pursuing an overlapping case.

Flight planning tools for comparing booking and fare details before paying

What this answer depends on

  • A potentially APPR-covered event that may also fall under a different passenger-rights regime. Coverage, remedy and prior payment must be assessed separately.
  • APPR section 3(3), subject to the Act, says a passenger must not be refused compensation merely because they are also eligible for compensation for the same event under another passenger-rights regime.
  • Canada Transportation Act section 86.11(3) prohibits receiving compensation under the relevant Canadian regulations after compensation for the same event has already been received under a different passenger-rights regime.
  • EU261 coverage itself depends on the flight’s geographic and operating-carrier conditions; a Canadian itinerary is not automatically an EU-covered itinerary.

Important exceptions

  • This article does not promise the difference between two regimes’ payment levels or authorize duplicate recovery. A meal reimbursement, airfare refund, goodwill benefit and statutory inconvenience payment can raise different questions; their legal characterization needs the actual documents. No universal rule for offsetting every kind of benefit is asserted.

What to do next

  1. Identify the potentially applicable regimes from the actual itinerary and operator. Do not choose a legal system just because its advertised maximum payment is larger.

  2. Make a list of submissions, decisions, accepted settlements and money or benefits already received. Record what each payment was for instead of labeling everything compensation.

  3. If the Canadian refusal cites only possible eligibility elsewhere, ask the carrier to distinguish APPR section 3(3) from the Act’s already-received restriction. Attach an accurate account of the other claim’s status.

  4. Before accepting an overlapping settlement, check its terms and the effect on the other request. Obtain individual advice where the same-event question or the nature of an earlier benefit is disputed.

  5. Keep both itineraries if separate tickets are involved, operator details, every claim reference, settlement wording, payment dates and a breakdown of the remedy each payment covers.
