Can a replacement flight create a new EU compensation claim after my original flight was canceled?

A second qualifying disruption can create a new compensation issue rather than being absorbed automatically into the original cancellation. Commission guidance expressly addresses an accepted rerouting flight that is itself canceled or arrives substantially late. Keep the two events and their evidence separate.

Traveler organizing trip records and next steps after a flight disruption

What this answer depends on

  • Flights and passengers within Regulation (EC) No 261/2004. Check departure, destination, operating carrier and the specific conditions below; the airline name alone does not establish coverage.
  • When an accepted Article 8 rerouting flight is also canceled or arrives at least 3 hours late, the guidance recognizes a new potential Article 7 compensation right.
  • The rerouting flight’s own disruption remains subject to the relevant compensation conditions and defenses.
  • Compensation for inconvenience is different from reimbursement of an expense; the same expense should not be claimed twice merely because two flights were affected.

Important exceptions

  • This does not mean every revised departure estimate produces a new compensation claim. The relevant replacement flight and qualifying second event must exist. A different operating carrier or jurisdiction can complicate responsibility, and extraordinary circumstances may affect one event but not the other.

What to do next

  1. Create one record for the original cancellation and another for the replacement. Include each flight’s operator, scheduled times, notices and actual outcome.

  2. Keep proof that the replacement was the airline’s accepted rerouting under the original disruption, rather than an unrelated journey purchased later.

  3. Ask the carrier to assess the second event on its own facts if it dismisses the request solely because compensation was already paid for the first. Disclose the first payment and what it covered.

  4. Itemize care expenses by date and identify any amounts already reimbursed. Keep the claim for a new fixed payment distinct from the continuing practical need for travel.

  5. Have both itineraries, the rebooking confirmation, separate causes and notice dates, final arrival evidence, payments already received and an expense ledger without duplicated receipts.
