When a canceled flight was part of a package, which requests go to the organizer and which may go to the airline?

Separate the package refund from the airline-disruption claim. EU guidance recognizes rights concerning both the organizer and operating carrier, but the same airfare is not simply refundable twice. A package-travel reimbursement entitlement can exclude an additional Article 8 airfare-refund claim against the airline while leaving a separate compensation issue.

What this answer depends on

  • Flights and passengers within Regulation (EC) No 261/2004. Check departure, destination, operating carrier and the specific conditions below; the airline name alone does not establish coverage.
  • Regulation 261 can apply to a flight forming part of a package; it does not apply merely because a package was canceled for a reason unrelated to cancellation of the flight.
  • Where the passenger has a package-travel right to reimbursement of the air ticket from the organizer, the guidance says the same airfare cannot also be claimed from the carrier under Article 8(2), even if the organizer cannot pay.
  • A qualifying fixed-compensation claim against the operating carrier may still exist for a disrupted package flight; overlapping compensation or price reductions must be accounted for to avoid overcompensation.
  • The organizer relationship is legally material. Establish package status; do not apply this branch to every OTA purchase.

Important exceptions

  • The legal package status and national implementation matter. This page does not determine insolvency protection or the organizer’s entire holiday liability. It remains within the airline-disruption issue; a hotel-only cancellation without a canceled flight belongs to a different problem.

What to do next

  1. Confirm that the booking is legally a package, rather than a flight and unrelated hotel purchased separately. Keep the organizer contract and identify the operating airline.

  2. Ask the organizer to explain the package reimbursement and assistance process. Record the part of any payment attributed to airfare and any separate price reduction.

  3. For an airline compensation claim, state the actual flight disruption, notice or delay, and operating carrier. Disclose organizer payments and specify that the claim is not a duplicate airfare refund.

  4. If the organizer is insolvent or refuses reimbursement, obtain advice on the applicable package protection mechanism rather than assuming the airline automatically becomes responsible for the same refund.

  5. Have the package contract, organizer identity, air ticket, actual flight cancellation or delay evidence, package refund calculation and all compensation or price reductions already received.
